The Electors shall meet in their respective states, and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice-President and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate;
The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted;
The person having the greatest Number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice. And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in the case of the death or other constitutional disability of the President.
The person having the greatest number of votes as Vice-President, shall be the Vice-President, if such number be a majority of the whole number of Electors appointed, and if no person have a majority, then from the two highest numbers on the list, the Senate shall choose the Vice-President; a quorum for the purpose shall consist of two-thirds of the whole number of Senators, and a majority of the whole number shall be necessary to a choice. But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.
The 27th Amendment
The twelfth article of amendment to the Consitution of the United States is hereby repealed. The people shall meet in the their respective voting stations and their votes shall be recorded and counted as a entire population, and the voters, now represented by every U.S. citizen, will elect our new president. The canidate who received the majority of the votes from the population, shall be decreed the new president of our country.
Why should The 12th Amendment be changed?
Although the Electoral College method has brought about some great presidents like Ronald Reagan, Bill Clinton, and Jimmy Carter They have also produced some poor Presidents such as Richard Nixon, and the infamous George W. Bush. However, this country is considered a democracy. Meaning the people form the government and elect the leaders, however the people do not elect the leader the people have to elect representatives to elect leaders. That is subduing the voice of the people, all of the people. The point of our government is to make sure every American voice counts. The Electoral College strategy does not. Therefore it should be eradicated.
For example, the 2000 election between George W. Bush and Al Gore is a prime example of Electoral College gone wrong. George Bush has driven the country into the ground. He has helped kill the economy and burned many relationships we had with other countries, however this could have been avoided. If the 2000 election was counted by only the popular vote then Al Gore would have won. 2000 Presidential Election: Popular Vote. Al Gore: 51,003,926 George W. Bush: 50,460,110. Electoral College Votes: Al Gore 266 George W. Bush: 271. The majority of the American people clearly wanted Al Gore as our president.
Also the Electoral College is a source of Inequality. This process of the Electoral College gives unequal distribution of voting power per citizen across the states, giving greater voting power to voters in states with less than average population and less to those with greater than average population. This discriminates half the voters especially our country’s minorities. This is actually a direct violation to the 14th Amendment, which is the Equal Protection Amendment. The contradiction between the 14th Amendment and the Electoral College allows the law to be used for immoral ends discrimination against minority citizens and diminishing their voice in government. Also the Electoral College prevents full compliance with the Universal Declaration of Human Rights of the UN, which calls for elections by universal and equal suffrage as a basic, unalienable right of all mankind. So this way of electing our leader is very flawed as you can see. They discriminate against minorites. They directly contridict the Constitution and don’t comply with a very important agreement that they made with the United Nations.
The Rebuttal
The people are the base of the electoral college, the elect the electors, who in turn elect the president, besides the electoral college rarely contradicts the popular vote directly.
